KUSSTOM LLC – TERMS AND CONDITIONS FOR HANDCRAFTED FURNITURE

Welcome to Kusstom LLC! Please review the following Terms and Conditions, which govern all purchases of our handcrafted furniture.

1. Order Policy

All furniture offered by Kusstom LLC is either:

Made-to-order (custom): Designed and built based on client specifications.
In-stock (as-is): Available for immediate purchase and shipment.

Placing an order constitutes acceptance of these Terms and Conditions.

2. Custom Orders & Deposits

A non-refundable deposit is required to initiate any custom order.
Production begins after deposit and confirmation of specifications.
Any changes to specifications after production begins may result in additional charges or delays.

3. Shipping & Delivery

In-stock pieces are processed and shipped within 7 business days of full payment.
Custom pieces typically ship within 3 to 5 weeks, depending on the complexity of the order and material availability.
- This timeline is an estimate and may be shorter or longer based on production variables.
Kusstom LLC will provide updates throughout the process and notify the client of any significant delays.

4. Returns & Refunds

Custom pieces are non-refundable once production begins.
In-stock items may be eligible for return within 7 days of delivery, provided they are unused and in original condition. Return shipping costs are the buyer’s responsibility.
Damaged or defective items must be reported within 48 hours of delivery for consideration.

5. Materials and Craftsmanship

Each piece is handcrafted and may vary slightly in color, texture, and finish due to the natural characteristics of the materials used. These variations are not defects but part of the uniqueness of handmade furniture.

6. Client Responsibility

It is the client's responsibility to:

Provide accurate specifications for custom orders.
Ensure delivery access and space for the item upon arrival.
Inspect items upon delivery for damage or defects.

7. Liability

Kusstom LLC is not liable for:

Delays caused by shipping carriers or material shortages.
Damages resulting from improper handling, care, or installation by the customer.

8. Governing Law

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes shall be resolved in the appropriate courts of St. Lucie County, Florida.

By placing an order with Kusstom LLC, you acknowledge and agree to these Terms and Conditions.

According to this agreement, the HANDYMAN agrees to provide his Handyman Services

and expertise to the HOMEOWNER, whereby the scope of the Handyman Services shall

include supply of labor, equipment and installation of the various articles related to

project.

The HOMEOWNER agrees to accept the services of the HANDYMAN keeping with the terms and

conditions of the agreement.

The HOMEOWNER will pay the HANDYMAN the amount shown above Plus Tax for the latter.

The HOMEOWNER must pay the invoice balance 5/3 business days before delivery or installation.

Booking fees are $350.00 nonrefundable after 72 hours

The term of the agreement shall begin from the day this contract is signed between the two

parties and all Handyman work must be completed within (the number of day show above) days of

signing

this contract, unless scope of job should change.

The HANDYMAN is responsible for the quality of his services and the Handyman equipment

provided to the HOMEOWNER.

The HOMEOWNER has the right to inspect the premises whenever he/she feels the need to.

. The HOMEOWNER will supply all product(s)/material(s) needed to complete the project before the

project start date.

. The HOMEOWNER will supply all ideas and concept regarding the nature of the project before

project start date.

. The HOMEOWNER will provide HANDYMAN access to premises during project timeline without

interference of pets and/or people.

Any changes or modifications that are made to the project after the contract date, the

HOMEOWNER will be responsible for any additional labor and equipment cost that may arise.

. Either party may terminate this agreement at any point in time by giving the other party at least 2

days’ notice, in writing, as to the effective date of termination.

. Advance deposit is non-refundable once work has started and/or (1)work day completed on site,

Pick up materials, and design.

Natural wood and Painted Finishes

For customers interested in purchasing our custom painted wood work, we would like you to know

there is no

misunderstanding regarding the inherent issues with painted wood. Woods exhibit certain

characteristics that may

be seen by some as defects, when in fact they are unavoidable, inevitable features in all painted

woods. Wood

expands and contracts with the seasons and as a result, the painted surface can crack or fracture.

Expansion and

contraction is unavoidable and will eventually alter the overall look of the painted surface. Cracks or

fracture lines

typically develop along assembly joints and can also occur from normal handling. Paint fracturing is

not considered

to be a defect and is not an indication of structural failure. Another certainty is what is referred to as

“bridging”

between the center panel and the frame. Paint bridging occurs when the coating material flows into

the gap between

the center panel and the frame. Although every effort is made to prevent this, small amounts of

bridging may still be

detected. As the panel and frame expand and contract, small hairline fractures may become visible.

It is important to

note that paint colors change over time due to exposure to light, pollution and chemicals. Additions

or replacements

may not initially match finished products already in place. In an effort to help educate and service our

clients, We

asks for your acknowledgment regarding the warranty waiver that applies to all of our wood work.

Kusstom LLC retains copyright in the designs and grants the Client

unlimited but non-exclusive rights for which the Client

pays.

Credit card refund policy

Processing fees will no longer be refunded to your Card/account when you issue full or partial

refunds.

Any payment for project development Idea, plan, 3D rendering, demonstration, consultation, travel

fees, and research.

Advance deposit in non-refundable once work has started.

The parties hereby indicate by their signatures below that they have read and agree with the terms

and conditions of this

Agreement in its entirety

Kusstom LLC retains copyright in the designs and grants the Client

unlimited but non-exclusive rights for which the Client

pays.
